Dear Secretary Kerry,
On behalf of the Vietnamese American citizens, we are writing this letter to express our disappointment in regard to the humiliating behavior of a high official of the Department of State.

When Mr. Ted Osius, the U.S. Ambassador to Vietnam, visited the Vietnamese American community in San Jose, California on July 14, 2015; he requested to remove our heritage flag (which is yellow background with three red stripes) at the venue that was not a federal facility. Not only asking to remove our flag, Mr. Osius had on his jacket the pin featuring the flags of the US and Communist Vietnam celebrating the 20th anniversary of the diplomatic relation between two countries. We see this as an impolite, unprofessional behavior that challenges our anti-communist community.

The yellow flag with three red stripes has been recognized by about three scores of States, Counties, Cities in the U.S. as the Freedom and Heritage Flag of the Vietnamese Americans. Although we lost to the Communists, we have been embracing the flag as the symbol and strong hope for a brighter day when democracy and freedom will be restored in our fatherland Vietnam.

The Department of State may not want to see our flag at its properties. By displaying the yellow flag, we both confirm our identity and exercise our freedom of expression that was written in the 1st Amendment of the Constitution of the United States. If anyone would feel uncomfortable seeing the flag, then, please, don’t come to us.
Mr. Osius’s disrespectful behavior was disgracing the feeling and pride of all Vietnamese Americans. We need an explanation from the Secretary Kerry and an apology from Mr. Osius.

Kính thưa ông Kerry,

Thay mặt cho các công dân Mỹ gốc Việt, chúng tôi gửi đến ông lá thư này để bày tỏ sự thất vọng về một viên chức cao cấp Bộ Ngoại Giao đã có hành vi xúc phạm đối với chúng tôi.

Khi ông Ted Osius, Đại Sứ Hoa Kỳ tại Việt Nam tiếp xúc với người Việt tị nạn CS tại San Jose ngày 14 tháng 7, 2015 vừa qua, ông ta đã yêu cầu tháo bỏ lá Quốc Kỳ VNCH tại phòng hội, là nơi không phải cơ sở của chính quyền Liên Bang.  Ngoài ra, khi tiếp xúc với người Việt tị nạn, ông Đại sứ đã đeo trên ve áo chiếc phù hiệu kỷ niệm 20 năm bang giao Mỹ-Việt Cộng, trong đó có hình lá cờ đỏ sao vàng. Chúng tôi xem đây là hành vi thiếu lễ độ, thiếu phong cách và là sự thách thức đối với người Việt chống Cộng.

Lá cờ Vàng ba sọc đỏ của chúng tôi đã được gần 50 thành phố, quận hạt và tiểu bang tại Mỹ thừa nhận là lá cờ Tự Do và Truyền Thống của người Mỹ gốc Việt. Dù chúng tôi bị lưu vong, nhưng vẫn ôm ấp lá cờ như là biểu tượng và niềm hy vọng về một ngày tươi sáng khi tự do và dân chủ vãn hồi trên quê hương Việt Nam của chúng tôi.

Bộ Ngoại Giao có thể không muốn treo lá cờ chúng tôi tại các cơ sở của Bộ. Nhưng đối với chúng tôi, khi treo lá cờ đó lên, là khẳng định lý lịch của mình cũng như thể hiện quyền tự do phát biểu có ghi trong Tu Chính Án số 1 của Hiến Pháp Hoa Kỳ.

Nếu một vị nào đó không cảm thấy thoải mái với lá cờ Vàng, thì xin đừng tìm đến với chúng tôi.

Việc làm bất kính của ông Đại Sứ Osius đã xúc phạm tình cảm thiêng liêng và niềm tự hào của tập thể người Mỹ gốc Việt. Chúng tôi đang chờ sự giải thích của ông Bộ Trưởng và lời xin lỗi của ông Đại Sứ.

Xin cám ơn ông về sự quan tâm đúng mức trong vấn đề này.

I am disappointed that you chose to write to my boss before checking the facts with me. I have always been straight-forward and respectful, and I expect the same in return.
Ambassador Osius made a point of visiting California during his recent trip back to the United States in order to meet with members of the Vietnamese-American community, hear their thoughts and concerns about U.S.-Vietnam relations, and explain our current policy, recognizing the tremendous contributions the Vietnamese-American community has made to our bilateral relationship.

The Ambassador had very substantive discussions, and listened carefully to the views and suggestions of the Vietnamese-Americans he met. As can be seen in this YouTube video ( https://l.facebook.com/l/UAQGDG7nSAQHSR62TGYtZtad5oX0bG5QjisBYpn8imLLhKg/https%3A%2F%2Fwww.youtube.com%2Fwatch%3Fv%3DbAfmBLbowbs – correct one?), Ambassador Osius was always polite and respectful, including in an exchange with a woman wearing the south Vietnamese flag. The Ambassador told her he respected the symbol and her right to display it, but also noted that, as the U.S. Ambassador to Vietnam, he preferred not to be photographed with it given the potential sensitivities. On no occasion, though, did he forbid anyone to display the flag or ask for all flags to be removed from the venues. Displaying the flag is obviously their lawful and legitimate right as American citizens.
